Terms of service

Terms and conditions TheWootz VOF, version May 2025

Article 1 – Applicability

1. These terms and conditions (hereafter: "Terms") apply to all offers, orders and agreements concluded through the webshop of TheWootz VOF (hereafter: "TheWootz") for the sale and delivery of products worldwide.
2. By placing an order, the customer accepts that these Terms apply.
3. Deviations from these Terms are only valid if TheWootz has confirmed them in writing.
4. The applicability of any purchasing or other conditions of the customer is expressly rejected.

Article 2 – Offer and agreement

1. All offers from TheWootz are without obligation and may be changed at any time.
2. An agreement is concluded the moment TheWootz confirms the order in writing or electronically, or by starting to carry it out.
3. TheWootz reserves the right to refuse orders without giving reasons.

Article 3 – Prices and payment

1. All prices are in euros (€) and include VAT, unless stated otherwise.
2. Payment is made through the payment methods offered in the webshop.
3. For business purchases, payment by invoice is possible, within the payment term stated on the invoice.
4. Customs charges, import duties or other taxes for international shipping are for the account of the customer.
5. Obvious errors in prices or other information in the webshop are not binding on TheWootz.

Article 4 – Delivery and shipping

1. TheWootz delivers worldwide and applies indicative delivery times as stated in the webshop.
2. Shipping is to the address provided by the customer. Incorrect address details are at the customer's risk.
3. Any additional costs such as import duties are for the account of the customer.
4. TheWootz is entitled to deliver in parts.
5. Delivery times are indicative. Exceeding them does not entitle the customer to compensation or termination, unless there is intent or gross negligence on the part of TheWootz.

Article 5 – Right of withdrawal

1. The consumer has the right to withdraw from the agreement within 14 days of receiving the product, without giving reasons, unless the product is personalised or made to measure.
2. The product must be returned unused, undamaged and in its original packaging.
3. The cost of returning the product is for the account of the customer.
4. In the case of damaged or used products, TheWootz reserves the right to charge for the loss in value.

Article 6 – Warranty and liability

1. TheWootz warrants that the products delivered comply with the agreement, the specifications and reasonable requirements of soundness and/or usability.
2. The warranty does not cover wear, damage caused by improper use, incorrect cleaning or use contrary to the instructions.
3. Use of TheWootz products, including (but not limited to) cutting boards, is entirely at the user's own risk.
4. TheWootz is not liable for any direct or indirect damage, personal injury or consequential loss arising from the use of its products. This includes, but is not limited to: cuts, injury, slipping, damage to objects, or any other accident caused by or in connection with the use of the board.
5. The liability of TheWootz is at all times limited to the amount paid for the product concerned.
6. The customer indemnifies TheWootz against claims from third parties relating to the use of the product.

Article 7 – Use and safety

1. The customer is responsible for following the instructions for use. TheWootz advises inspecting the product thoroughly before use.
2. Use by children under the age of 16 must always be supervised by an adult.
3. TheWootz accepts no liability whatsoever for damage caused by incorrect or reckless use of the product.

Article 8 – Privacy and data processing

1. TheWootz processes personal data in accordance with applicable privacy legislation (GDPR).
2. Personal data is used only to carry out the agreement and will not be provided to third parties, unless required by law.

Article 9 – Intellectual property

1. All intellectual property rights in the products, designs, images, texts and other content in the webshop and on the social media of TheWootz belong exclusively to TheWootz.
2. Without prior written permission it is not permitted to copy, distribute or otherwise use this material.

Article 10 – Applicable law and disputes

1. These Terms are governed exclusively by Dutch law.
2. Unless mandatory law provides otherwise, disputes will be submitted to the competent court in the district where TheWootz is established.
